Media IS reporting on it, but the truth of the matter is that the hearing is ONLY for a chief justice (Paul Crampton) to assess remarks from TWO RANDOM GUYS FROM NOVA SCOTIA who filed a complaint, and those of the federal lawyers who argue that there is no basis for an official hearing. That's it. That's all. This is not a "prorogation hearing", much as Dan the "Journalist" would love for you to believe.
The reality is Trudeau might win this legal battle. We do not have any rights in Canada that are not dependent on the government agreeing to them. Canada is essentially a five year long dictatorship. It always has been. But previous PMs tempered their absolute power.
Prior to the charter and the Constitution Canadians had rights conferred by British Common Law. The right to free speech for example. The imposition of the Charter specifically overrode common law. It stated the Charter takes precedence over common law. Section One of the Charter states the rights listed therein are limited by what the Government thinks is reasonable!! Our rights cannot override the governments determination as to their reasonableness tempered by good governance!! In other words they can say what is reasonable and our ‘rights’ must conform. Free Speech? Not if what you are saying is unreasonable according to the PM of the day.
Sounds as if the judge might not give them what they want. After all, another judge ruled their use of the EA was unconstitutional. But I can see if they lose, immediately appealing it which would lead to what, would they continue to drag their heels and not recall parliament until the appeal is sorted? Ignore the ruling? I can’t see them giving up easily, they’ve come too far.
Time to scrap this evil fruit of an evil tree (Trudeau Sr.). People (lawyers especially) blather on about the Charter as if it's some divine instrument; as if we had no rights whatsoever prior to its existence. It's garbage. I suspect that the election campaign will start before the ruling is released and Liberals will glow in their smugness about just how clever they are.
